Why is there a 12-month minimum term?
This is to ensure the labour, equipment, and setup costs are covered while keeping your business cash flow predictable and manageable.
Do I actually own the website?
Yes. You own the design and architecture outright once the initial 12-month term is settled. Any domain registered for the project is also held in your name.
Who writes the website text?
You provide the core information about your business. During Phase 2 (The Deep Dive), this copy will be refined to ensure it aligns with the design of the site.
What happens after the 12 months?
No price hikes or exit fees, the agreement simply moves to a 30-day rolling contract. We continue to host, secure and maintain the site for you. Should you wish to leave and handle it yourself, you can request a transfer.

Active Subscriptions

We retain all project files, website data, and photography media for the entire duration of your active subscription.

Post-Cancellation

Upon cancellation, we retain your project files for 90 days to allow for a final handover or data recovery. After this period, files are deleted from our active storage.

Financial Records

We are required by law to keep contact and billing information for seven years following the end of your subscription for tax and insurance purposes.

Terms of Service


These Terms of Service govern the agreement between Lindis (“we”, “us”) and the client (“you”) for web design, photography, and ongoing website management services. By proceeding past Phase 1 and confirming your project, you agree to the terms set out below. These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.



Section 1: The Service

Lindis provides a bespoke web design, professional photography, and ongoing website management service for small and medium-sized businesses based primarily in Cumbria and the surrounding region.

Our package includes:- up to 5 bespoke webpages fully responsive across mobile, tablet, and desktop.- 1-hour on-site professional photoshoot at your business or chosen location.- edited high-resolution photo library delivered within 5-7 working days of the shoot.- domain registration and configuration.- ongoing SSL security and protection.- 30 minutes of monthly maintenance covering text edits, image swaps, and minor layout adjustments.

Copy refinement is included as part of the build process. You are responsible for providing the raw content and information about your business. We will shape, refine, and structure that content into suitable website copy. We do not provide full copywriting from scratch without agreed additional fees.Any work or features outside the scope of the standard package including: additional pages, booking system integration, e-commerce functionality, or structural redesigns will be quoted separately before any work begins.


Section 2: The 12-Month Term

All projects are agreed on a minimum 12-month term. This structure allows us to deliver a professional website, photography, and setup at no large upfront cost to you, with the investment recovered across the subscription period.

Your first monthly payment of £50 is taken when you confirm you would like to proceed at the end of your Intro Call. This marks the formal start of your agreement. Subsequent monthly payments of £50 are taken on the same date each month following your initial payment.

Cooling-Off Period

You have a statutory 14-day cooling off period from the date of your first payment, during which you may cancel your agreement and receive a full refund with no questions asked. To exercise this right, simply notify us in writing by email within 14 days of payment.

During the cooling off period we will carry out only the initial Strategy Phase work, including sending your design brief and holding your consultation call. No photography, domain registration, or technical build work will begin until the cooling off period has expired. This ensures that if you choose to cancel within 14 days, your refund is clean and straightforward with no deductions.

From day 15 onwards your agreement is fully active and the terms set out in Section 6 apply to any early exit.

If you do not complete your design brief within 7 days of receiving it, your project slot may be released and rescheduled subject to availability.


Section 3: The Ownership of Assets


Your photography

The photo library created during your shoot is yours from day one. You hold a full licence to use the images across your website, social media, print materials, and any other marketing activity. There are no ongoing licensing fees or restrictions on use.

Your domain

Any domain registered as part of your project is registered in your name. You remain the legal owner of your domain at all times, regardless of the status of your subscription.

Website - During the Subscription

During the active subscription period, the website is hosted and managed by Lindis. We retain the right to host your site on our chosen infrastructure for the duration of the agreement.All intellectual property in work-in-progress, including design files, code, and website structure, remains with Lindis until the 12-month term is successfully completed. In the event of early cancellation, Lindis retains ownership of all unfinished and delivered website assets, with the exception of your photography library and domain, which remain yours unconditionally.

Website - After the Initial Term

Upon completion of the initial 12-month term, you own your website outright. At this point you have the choice of continuing with one of our two rolling managed service plans, or transferring the site to self-management. Full details of all options are set out in Section 7.


Section 4: The Monthly Maintenance

Your monthly fee includes up to 30 minutes of maintenance per calendar month. This covers small text edits, image swaps, and minor layout adjustments to keep your site current.

Maintenance requests should be submitted by email. We aim to action all standard requests within 2 to 3 working days of receipt.

Requests that exceed 30 minutes per month, or that involve structural changes, new page builds, or significant design alterations, will be quoted separately at an agreed hourly rate before any additional work begins. Unused maintenance time does not roll over to the following month.


Section 5: Your Responsibilities

To ensure your project runs smoothly and to the agreed timeline, you agree to:- Provide timely responses to briefs, consultation requests, and review stages. Delays caused by late client responses may affect your project delivery date.- Ensure that your business premises or chosen shoot location are accessible and reasonably prepared for the photoshoot on the agreed date.- Provide a minimum of 48 hours’ notice if a shoot needs to be rescheduled. Rescheduling within 48 hours of the shoot may result in an additional booking fee.

Client-Supplied Content

You warrant that all text, images, logos, and other materials you supply to Lindis for inclusion on your website are either owned by you or that you have obtained the necessary rights and permissions to use them. You confirm that the use of such materials will not infringe the intellectual property, privacy, or other rights of any third party, and that they do not contain content that is unlawful, defamatory, or otherwise harmful.You agree to indemnify and hold harmless Lindis against any claims, losses, damages, costs, or expenses (including reasonable legal fees) arising from any breach of this warranty.


Section 6: Early Exit and Cancellation

If you choose to cancel your agreement before the end of your 12-month term, a buyout fee will apply. This fee is a genuine pre-estimate of the losses incurred by Lindis as a result of early termination, reflecting the cost of the design, photography, setup work, and ongoing hosting already delivered on your behalf.

The buyout fee reflects the genuine cost of creative and technical work delivered upfront on your behalf, including consultation, photography, and website build, which represents a minimum of 15 hours of professional time. This front-loaded investment, comprising a 30-minute consultation, a 1-hour photoshoot, and approximately 14 hours of photo editing, website design, build, and domain configuration, is recovered across the 12-month subscription period. This means early cancellation results in a genuine financial loss to Lindis.

The buyout fee is therefore equivalent to the remaining monthly payments outstanding at the point of cancellation, capped at £600, and is not intended as a penalty. Example: if you cancel at month 4 having paid £200, the buyout fee would be the remaining 8 months of payments, totalling £400. The cap of £600 applies to the maximum buyout at any point in the term.

Your photography library and domain remain yours regardless of early cancellation.

Cancellation requests must be submitted in writing by email. Verbal cancellations will not be accepted. The cancellation takes effect from the date the written request is received.

Lindis reserves the right to terminate this agreement immediately and without liability in the event of non-payment beyond the grace period set out in Section 8, abusive conduct, or a request to publish content that is unlawful, defamatory, or otherwise harmful.

We understand that running a small business is not always straightforward. If you experience genuine financial hardship or your business closes during the 12-month term, we encourage you to get in touch with us directly rather than assuming the full buyout fee applies automatically. We will always seek to discuss your situation individually and find a fair resolution where possible.


Section 7: After the Initial Term

Once your 12-month term is complete, your subscription automatically transitions to a rolling monthly plan. At month 11, we will contact you to discuss preferences and confirm which option you would like to move to.If we do not receive a written request for an alternative arrangement before the end of month 12, your subscription will automatically continue on the Standard Plan at £30 per month.All rolling plans operate on 30 days written notice to cancel with no exit fees.

Full Technical Management

We remain responsible for all hosting, security, domain renewals, and ongoing monthly maintenance updates (see section 4) providing a fully "hands-off" solution.

Price Lock Guarantee

Your monthly fee remains fixed at the rate agreed at the start of your subscription for as long as you remain an active client. No price rises.

No Exit Fees

After the initial 12 month term, there are no charges from us if you choose to cancel, we just require 30 days' written notice.


Premium Plan, £40 per month

All of the above + Annual Photography Refresh

In addition to all of the above, you are entitled to a 1 hour photography refresh session per year, available from the start of your rolling monthly plan.This session must be requested with a minimum of two weeks notice, subject to availability, and must be taken within the relevant 12-month period. Unused sessions do not carry over to the following year.


Self-Hosting

Should you wish to manage your website independently, upon request, we will facilitate a full transfer of your site.By committing to hosting independently you acknowledge that certain ongoing costs are required to keep the website live. These are no longer covered by your subscription and become your sole responsibility:Platform & Hosting Fees: You will be responsible for the direct costs of the third-party platform and hosting infrastructure required to power the site.Domain Renewals: Responsibility for domain name renewal and associated registry fees will transfer to you. Failure to renew these may result in the loss of your web address and site downtime.Once the transfer is complete, you also assume full responsibility for maintenance, updates and security.


Section 8: Payment

All payments are taken monthly by the payment method registered during the Strategy Phase. Payments are due on the same date each month, beginning on the date of your first payment as set out in Section 2.

During the initial 12-month term your monthly payment is £50. From month 13 onwards your monthly payment will be £40 on the Premium Plan or £30 on the Standard Plan, as confirmed during your month 11 review.

If a payment fails, we will notify you and allow a grace period of 7 days to resolve the issue. If payment remains outstanding beyond this period, we reserve the right to suspend your website until the account is brought up to date.

Where payment remains outstanding beyond the 7-day grace period, Lindis reserves the right to charge statutory interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, currently set at 8% per annum above the Bank of England base rate, accruing daily from the date the payment became overdue.

Persistent non-payment may result in termination of the agreement and activation of the early exit fee process for any outstanding balance.

All fees are quoted in pounds sterling and are inclusive of any applicable taxes unless otherwise stated.


Section 9: Liability

Lindis will make every reasonable effort to ensure your website remains live, secure, and performing throughout your subscription. However, we cannot guarantee uninterrupted service, as website hosting is subject to factors outside our direct control, including third-party platform outages.

We accept no liability for any loss of business, revenue, or opportunity arising from website downtime, technical issues, or delays in the build or maintenance process.

Our total liability to you in connection with this agreement shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.


Section 10: Force Majeure

Lindis shall not be liable for any delay or failure to perform its obligations under this agreement where such delay or failure results from circumstances beyond our reasonable control. These include, but are not limited to: illness or medical emergency, bereavement, natural disaster, acts of God, failure of third-party platforms or infrastructure providers, or any other event that could not reasonably have been anticipated or prevented.

In the event of a force majeure occurrence, Lindis will notify you as soon as reasonably practicable, and will make every effort to resume normal service as quickly as possible. The affected obligations will be suspended for the duration of the event. Where a force majeure event continues for more than 30 consecutive days, either party may terminate the agreement in writing without penalty, and a pro-rata refund of any prepaid fees will be issued.


Section 11: Portfolio and Promotion

Unless you request otherwise in writing, Lindis reserves the right to feature your completed website and photography in our portfolio, on our own website, and across our social media channels as examples of our work.

If you would prefer your project to remain private, please notify us in writing before your site goes live and we will respect that request entirely.


Section 12: Photoshoot Rescheduling

In the event that Lindis needs to cancel or reschedule a photoshoot, we will provide a minimum of 48 hours’ notice wherever possible. We will work with you promptly to agree a suitable alternative date at no additional cost to you. Where less than 48 hours’ notice is given by Lindis through no fault of your own, you will not be charged any rescheduling or rebooking fee.


Section 13: Data and Privacy

Any personal data you provide to Lindis, including your name, email address, business details, and payment information, will be handled in accordance with our Privacy Policy and in compliance with the UK General Data Protection Regulation (UK GDPR).

We will never sell, share, or transfer your personal data to third parties for marketing purposes. Data is retained only for as long as is necessary to deliver the service and meet our legal obligations.

You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us in writing. Please refer to our Privacy Policy for full details.


Section 14: Changes to These Terms

Lindis reserves the right to update these Terms of Service from time to time. Where changes are material, we will notify existing clients by email with a minimum of 30 days notice before the changes take effect.

Where a material change would impose additional obligations on you as a client, you have the right to terminate the agreement within the notice period without incurring any early exit fee. If you do not exercise this right within the notice period, continued use of the service will constitute acceptance of the updated terms.
